Terms of Service – VIP Vybz

1. Acceptance of terms

By accessing or using VIP Vybz, you agree to be bound by these Terms of Service. The service includes this website (vipvybz.com or related domains) and the VIP Vybz mobile application, including any use of the service through the app (e.g. joining a VIP circle with an invite code, booking or managing sessions, and receiving communications from hosts or the service). If you do not agree to these terms, do not use the service.

2. Description of the service

VIP Vybz allows professionals (hosts) to create VIP circles and invite clients via access codes. Clients who receive an invite can register in the app using that code, then view availability and book or manage sessions with their host. The service is provided through our website and our mobile app, which connect to our backend systems. We may modify, suspend, or discontinue any part of the service with reasonable notice where practicable.

3. Use of the service

You agree to use the service only for lawful purposes and in accordance with these terms and any applicable local, state, national, or international laws. You must not use the service to harass others, impersonate any person or entity, transmit harmful or illegal content, or attempt to gain unauthorized access to any part of the service or other users’ accounts. Hosts are responsible for the accuracy of the sessions and information they make available; clients are responsible for the accuracy of information they provide when registering or booking.

4. Accounts and invite codes

To use the app, you may need to register an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Invite codes are intended for the recipient only; you must not share or misuse invite codes. We may suspend or terminate accounts that violate these terms or that we reasonably believe pose a risk to the service or other users.

5. Subscriptions and in-app purchases

Certain features of the VIP Vybz mobile app may require a paid subscription or add-on purchased through the Apple App Store or Google Play ("in-app purchases").

Pro plan: A recurring subscription that unlocks professional tools in the app, including Manage My Vybz and My VIP Circle (subject to your account type and eligibility).
Staff add-on: An optional recurring subscription that, where available for your account, unlocks Manage Staff and related team features in addition to your Pro access.

Billing and merchant of record. In-app purchases are processed by Apple or Google, as applicable. You agree to the applicable platform’s terms and payment terms when you make a purchase. VIP Vybz is not the merchant of record for those transactions; Apple or Google (as applicable) processes payments and provides you with transaction receipts.

Pricing and duration. Subscription length, renewal frequency, and the price charged are shown in the app and at checkout in the store before you confirm a purchase. Prices may vary by region and are displayed in your local currency where the store provides it.

Auto-renewal. Paid subscriptions renew automatically for successive periods until you cancel through the store account you used to subscribe, unless the subscription is discontinued in accordance with the store’s rules.

Cancellation and management. You can manage or cancel subscriptions through your Apple ID or Google account settings. For convenience, you may use: Apple subscription management or Google Play subscriptions. Canceling stops future charges; you typically retain access until the end of the current billing period, as determined by the platform.

Refunds. Refund requests for in-app purchases are handled by Apple or Google according to their policies, not by VIP Vybz directly. If you have a billing issue, contact Apple Support or Google Play support as appropriate.

Free trials and promotions. If we offer a free trial or promotional pricing, the terms (including duration and conversion to a paid subscription) will be presented at the time of purchase in the store.

Changes to offerings. We may add, change, or discontinue subscription plans, add-ons, or features where permitted by applicable law and the app stores’ policies. Material changes will be communicated as required by law or platform rules.

Entitlements. We verify subscription status using our backend systems and, where applicable, third-party subscription services. If a subscription expires or is revoked, access to paid features may be limited or removed without a separate notice beyond what the store provides.

6. Intellectual property

All content and materials provided through VIP Vybz (including but not limited to text, graphics, logos, and the design of the website and app) are owned by us or our licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our materials without our prior written permission, except as necessary to use the service in the normal course.

7. Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy or completeness of any content provided by hosts or other users. Your use of the service is at your sole risk.

8. Limitation of liability

To the maximum extent permitted by applicable law, VIP Vybz and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) arising from or related to your use of the service, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising from these terms or the service shall not exceed the greater of (a) one hundred dollars (USD), or (b) the total fees you paid directly to VIP Vybz (excluding amounts you paid to Apple or Google for in-app purchases) in the twelve months preceding the claim. Nothing in these terms limits any liability that cannot be limited under applicable law, or your remedies with Apple or Google for in-app purchases as provided by those platforms. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability will be limited to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify and hold harmless VIP Vybz and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the service, your violation of these terms, or your violation of any third-party rights.

10. Changes to the terms

We may update these Terms of Service from time to time. We will post the updated terms on this page and update the "Last updated" date. Material changes may also be communicated via the app or by email where appropriate. Your continued use of the service after the effective date of any changes constitutes your acceptance of the updated terms. If you do not agree to the new terms, you must stop using the service.

11. General

These terms constitute the entire agreement between you and VIP Vybz regarding the service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision does not waive that right or provision. These terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict-of-law principles.
